Delegation to the Chief Privacy Officer

This delegation vests the authorities of the Secretary of the Department of Homeland Security in the Chief Privacy Officer and Chief Freedom of Information Act (FOIA) Officer responsibilities, to include:

  • Authority over management, governance, and oversight of Component Privacy/FOIA activities;
  • Approval authority over Departmental hiring of Component Privacy and FOIA Officers, including participating in identifying, recruiting, and hiring these personnel, and exercising concurrence authority for annual performance reviews; and
  • Coordination authority over disclosure of records subject to FOIA/FOIA litigation.
