ORLANDO, Fla. — A Homeland Security Investigations (HSI) Orlando investigation has led to the return of the grand jury indictment charging a previously convicted Florida man with enticing a minor to engage in sexual activity and committing a felony offense involving a minor when required to register as a sex offender.
Delta Henry Rushing II, 29, of Orlando, faces a mandatory minimum penalty of 20 years, up to life, in federal prison if convicted on all counts. The indictment also notifies Rushing that the United States intends to forfeit assets that Rushing used to facilitate the offenses.
According to the indictment, between Nov. 3 and Dec. 5, 2022, Rushing, a prior convicted sex offender, enticed an individual he knew was under the age of 18 to engage in sexual activity.
An indictment is merely a formal charge that a defendant has committed one or more violations of federal criminal law, and every defendant is presumed innocent unless, and until, proven guilty.
This case was investigated by HSI Orlando and the Metropolitan Bureau of Investigation. U.S. Attorney Roger B. Handberg announced the return by a grand jury of an indictment, and the case is being prosecuted by Assistant U.S. Attorney Kaley Austin-Aronson.
