  • Department of Justice Protections Against Employment Discrimination Based on Citizenship, Immigration Status, and National Origin

The Department of Justice’s Civil Rights Division (CRT) enforces a part of the Immigration and Nationality Act that protects non-U.S. citizens with permission to work in the United States and U.S. citizens against certain types of employment discrimination based on citizenship, immigration status, and national origin. Someone who believes they’ve been discriminated against can file a charge with CRT’s Immigrant and Employee Rights Section. CRT also has free hotlines for workers and employers. With a caller’s permission, sometimes the Immigrant and Employee Rights Section can offer to contact an employer to help a worker resolve an employment-related issue directly, without the need for any investigation. CRT also has several educational materials discussing rights and obligations under this anti-discrimination law, including materials in multiple languages discussing employment rights for asylees and refugees; Temporary Protected Status beneficiaries; work-authorized individuals arriving under Operation Allies Welcome and Uniting for Ukraine; and workers being run through E-Verify. Additional materials provide information to employers on how to avoid unlawful discrimination when hiring employees and when verifying their permission to work
