CRCL Recommendation and Investigation Memos Collection

The DHS Office for Civil Rights and Civil Liberties reviews and investigates civil rights and civil liberties complaints and alleged abuses filed by the public regarding DHS policies and activities. The investigations involve a range of alleged abuses, including violation of rights while in immigration detention. CRCL issues recommendations to the relevant DHS Component aimed at addressing any civil rights or civil liberties concerns identified as part of its investigation. Redacted memos and other documents related to these investigations are included in this library.

  • Recommendations Memo to ICE Concerning Irwin County Detention Center in Ocilla, Georgia

    This memorandum documents the actions of CRCL with regard to Irwin County Detention Center in Ocilla, GA, and provides two overall recommendations to ICE.

  • CRCL Recommendation Memo to CBP: Vehicular Pursuits

    This memorandum provides analysis and subsequent recommendations by CRCL in connection with an investigation into multiple instances of serious bodily injury or death resulting from U.S. Customs and Border Protection (CBP) vehicular pursuits and likely resultant crashes.

    The purpose of this memorandum is to inform CBP about the results of an investigation conducted by CRCL into the allegation that CBP discriminated against the complainant in violation of Section 504 of the Rehabilitation Act of 1973, as amended, 29 U.S.C. § 794(a) (Section 504).

  • Recommendation Memorandum to CBP: CBP Office of Professional Responsibility

    On September 2, 2022, CRCL issued CBP this memorandum providing recommendations in connection with a Use of Force Report of Investigation put forth by the CBP Office of Professional Responsibility.

  • Recommendations Memo to ICE Concerning Clay County Jail

    This memorandum provides recommendations in connection with a complaint alleging that Clay County Jail (Clay County) in Brazil, Indiana failed to comply with the 2008 U.S. Immigration and Customs Enforcement (ICE) Performance-Based National Detention Standards (PBNDS 2008) as required by ICE’s contract with Clay County.  CRCL concludes that Clay County failed to comply with the PBNDS 2008 when it reclassified an ICE detainee to a higher security level without new evidence or information, in order to alleviate a housing shortage for women detainees at the facility.

  • Recommendation Memorandum to CBP: Montreal Preclearance Inspection

    On August 22, 2022, CRCL issued to CBP this memorandum providing recommendations to CBP after CRCL’s investigation into an allegation that CBP discriminated against a traveler because of his mental health during his preclearance inspection at the Montreal Trudeau International Airport. 

  • Retention Memo to USCIS Concerning Houston Asylum Office

    This memorandum notifies USCIS of complaints, describes allegations, and informs USCIS that CRCL retained these complaints for investigation.

  • Retention Memo to ICE Concerning Orange County Jail

    This memorandum notifies ICE of complaints, allegations, and informs ICE that CRCL will retain complaints for investigation of Orange County Jail in Goshen, NY.

  • Close Memo to ICE Concerning Worcester County Jail

    This memorandum concludes the investigation that CRCL conducted into allegations related to ICE detainees at the Worcester County Jail in Snow Hill, Maryland. Following a collaborative process between CRCL and ICE, CRCL is closing the complaints.

  • Close Memorandum Regarding Investigation at Rio Grande Valley Sector

    This memorandum concludes the investigation that CRCL conducted into allegations related to detention conditions for individuals held in CBP custody in the Rio Grande Valley (RGV) Sector, including the RGV Central Processing Center and the Border Patrol stations in McAllen, Rio Grande City, and Harlingen, Texas.
